산학협력에 기반한 국가 수준 직업교육 체계화 법제 연구

Abstract

...이 연구 결과를 통하여 미래 교육 환경 변화에 따른 산학협력 기반의 직업교육 생태계 구축을 위하여 요구되는 제도 개선과 함께 직업교육 관련 법령의 개정 또는 제정과 관련된 쟁점을 도출함과 동시에 직업교육법(가칭)의 제·개정의 철학적 근거와 추진 방향을 설정하고, 직업교육법(안)의 구성 요소별 법 조항의 주요 내용을 제시하였다. 먼저 산학협력 기반 직업교육 생태계의 범위를 기초 직업교육부터 성인 전문직업교육으로 설정하고, 헌법에서 개인에게 보장하고 있는 교육의 권리, 근로의 권리, 직업 선택 자유 권리, 인간다운 생활 유지 권리 등을 직업교육에서 구현할 수 있는 법적 근거 마련과 함께 이에 따른 쟁점을 도출하고, 관련 분야 전문가들의 인식과 요구를 파악하였다. 특히, 직업교육 전반에 걸쳐 ‘일과 노동의 가치를 이해하고 존중할 수 있는 역량있는 인간상’을 구현하기 위한 법적 근거와 쟁점을 도출하였다. 둘째, 외국 사례 중에서 ‘일-학습-삶 연계된 직업교육 생태계’의 우수 사례이면서 4차 산업혁명 등 외부 환경 변화에 따른 직업교육법률을 개정한 독일 사례를 집중 분석하여 직업교육법(가칭) 제정을 위한 철학적 근거와 추진 방향을 모색하였다. 셋째, 교육기본법-(초중등교육법, 고등교육법, 평생교육법, 직업교육법) 등의 법적 체계의 적절성을 파악함과 동시에 직업교육법 제정을 위한 법적 구성요소와 조항 등을 구안하고, 관련 법률 중 개정이 필요한 법 조항 및 쟁점 등을 도출하였다.

Therefore, through the study result, we try to enhance the institution which needs to establish a vocational education system based on industry-academic cooperation according to the environmental change of the future vocational education. Moreover, we draw out issues related to the revision or enactment of the statute which has relevant to vocational education. At the same time, we set the direction and the philosophical proof of the Vocational Education Act (tentative name) and present the primary contents of legal provisions for each component of the vocational education act (draft). First, we set the range of vocational education systems from basic vocational education to professional education for adults based on industry-academic cooperation. We devise the legal evidence for implementing the right to receive an education, the right to work, freedom of occupation, and the right to live a life worthy of human beings in vocational education and identify the perception and need of experts in related fields. Especially, we draw out the issues and legal evidence to establish the human models which can understand and respect the value of work throughout the whole vocational education. Second, we seek the philosophical grounds and direction to enact the Vocational Education Act by analyzing an excellent case of the ‘work-education-life vocational education system’ in Germany that revised the vocational education act as the external situation changes. Third, we apprehend the appropriateness of the present legal system such as the Framework on the Education Act, and devise legal components and provisions for the enactment of the Vocational Education Act. ...
